What is Overstay?
Overstay is the foreigners residing in Thailand beyond the permitted date on stickers, visas and inbound stamps.
For example, you enter Thailand on 1 August with a 60-day tourist visa and are permitted to stay until 29 September. If you remain in Thailand after 29 September without renewing or extending your Thai visa, it assumes that you overstay and have to pay fines. Also, you are not allowed to enter the Kingdom under the conditions and time specified by the Ministry of Interior.
What will happen if you stay exceed your visa or permit of stay in Thailand?
- When realizing that you stay exceed your visa, you should solve the problem as soon as possible. Even if you overstay just 1 day because it is considered illegal in Thailand and a high risk of imprisonment.
- If you are detected that stay exceeds the visa limit in Thailand, you will be detained and punished in the Thai Immigration Detention Center. After that, you will be deported or imprisoned in Thailand.
- But if you haven't been detected and will leave Thailand, you have to pay a fine of 500 baht per day, a maximum of 20,000 baht including being banned from entering Thailand again.
However, it depends on the intent and duration of your overstay.
Overstay can occur in many cases. For example:
- No intention to overstay, such as misunderstandings about visa expiration dates or residence permits. When realizing, you have to hurry to pay fines at the Immigration Checkpoint before traveling out of the country.
- There is a need to overstay such as an accident or illness resulting in a stay and cannot extend the visa or extend the period of stay in time.
- Intention to overstay, such as knowing the date of the visa expiration but intend to not extend the visa or extend the period of stay. In this case, there is a high chance of being permanently banned from Thailand and imprisoned.
Occasionally, the Immigration Police often random check foreigners staying in entertainment venues on the streets, popular places of tourists, companies that hire foreigners to work, and various checkpoints. Therefore, to not be at risk of being arrested, you should not overstay or residence permits. What the penalties are for overstay?
- If staying longer than the allowable period, you can surrender at the Immigration checkpoint before traveling outside Thailand with a fine of 500 baht per day and a maximum of 20,000 baht (when staying more than 40 days).
- If staying longer than the allowable period and not traveling outside of Thailand (90 days or more) is a serious offense. You must be punished by law with a fine of 20,000 baht and deported and do not allow to enter Thailand for the specified overstay period.
For example, Russian tourists traveling to Thailand with a 30-day tourist visa, and the visa expiration date is 31 January. He / She misunderstands that the visa validity is 45 days, so stay longer until the return date, 5 February.
